Hello Watch Water Customers,
We are delighted to inform you that our products have been confirmed to not require a Proposition 65 listing. This update comes following an extensive review and official communication from the Office of Environmental Health Hazard Assessment (OEHHA).
Understanding Proposition 65
California’s Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, mandates businesses to provide warnings for products that could expose consumers to chemicals known to cause cancer or reproductive toxicity. However, businesses are not required to register their products with the OEHHA.
The law requires warnings only if the average user is exposed to listed chemicals during the product’s lifetime. If exposure levels are at or below the safe harbor levels established by OEHHA, warnings are not necessary. In cases where no safe harbor level exists, businesses must demonstrate that exposure levels do not pose a significant risk.
OEHHA Confirmation
We have received the following clarification from OEHHA:
“There is no requirement for businesses to register their products with our office. Under Proposition 65, businesses are responsible for determining if their products require warnings by exposing individuals to listed chemicals. Warnings are not required if the average user of a product is not exposed to any Proposition 65 chemicals during the lifetime of the product. Additionally, warnings are not required if exposures are at or below safe harbor levels that our office has established for many Proposition 65 chemicals.”
This means our products do not expose users to Proposition 65 chemicals at harmful levels, ensuring their safety and compliance with California regulations.
